New Law In The State Of Nevada Goes Into Effect For 2020

Nevada has signed a new bill into law ready to come into effect as early as 2020. The new law states that It is unlawful for any employer in this State to fail, or refuse to hire a prospective employee because the prospective employee submitted to a screening test and the results of the screening test indicate the presence of marijuana,". Nevada is actually the first state in the United States of America to implement such a law, as their recreational marijuana industry flourishes. The new law was signed by Gov. Steve Sisolak on June 5. Anyone working as an Emergency staff, which would include Fire-fighters, EMT and the majority of the industry that is heavily involved in the operation of a motor vehicle, by law, are considered exceptions to the rule. Meaning, they will still be required to and held fully accountable to the employer, for their testing results.The new law should have a more positive effect on the recreational industry, since it legally protects and secures current and prospective employment opportunities for the recreational consumer. The question still remains, will the prospective employer be a little more user friendly to the recreational consumer?The law specifically states, that a current or prospective employer can deny employment if by the determination of the employer, a positive result could adversely affect others' safety.  The Nevada Govenor believes that as the state's legal cannabis industry continues to flourish, it's important to ensure that the door of economic opportunity remains open for all Nevadans. He also reiterated that That he was proud to sign AB132 into law, which contains common-sense exceptions for public safety and transportation professionals."

Does This New Law Infringe On Your Rights As A Business Owner?

I do believe this new law which goes into effect January 2020 is a small step in the right direction with regards to the Marijuana Industry. Now the question at hand is, due to it's lawful nature, does infringe or interfere with our free market system. I see it as a grey area. I do believe as a business owner you have the right to set as well as maintain minimum  standards fro employment as well as continued employment. I also feel as if it is slightly contradictory in nature where anyone on state or federal payroll cannot participate yet as a business owner you cannot make that determination. A more user friendly approach would be to leave it up to the hiring authority to decide but require them to be transparent, in writing on their stance on such a controversial issue. Alcohol is a highly addictive and intoxicating substance, yet it's usage on a recreational level does not affect employment, Marijuana should be treated the same. When you take a look at alcohol related negatives such as accidents, incarceration and rehabilitation, it has a way more notorious background when compared to Marijuana usage and continues to be a liability on the Governments balance sheets, yet it is still a very profitable industry and is heavily promoted through the media.

A Small Boost In Sales

I believe that the Dispensaries are the biggest beneficaries of this new law. Prospective applicants can now rest assured that they wont face discriminatory issues with regards to marijuana usage and employment depending on their industry. As Marijuana usage becomes more prevalent and socially acceptable in our modern society, it can make certain industries less attractive to prospective applicants creating shortages in certain job fields. Employers should adopt the alcohol approach towards Marijuana usage and the so called economic opportunity should be open to all where you cannot work under intoxicating conditions. Like alcohol usage, Marijuana intoxication does portray visual signs such as slurred speech, pupil dialation and a strong aroma.
